Earthwork Advisory Committee

Per appointment of the Berlin Board of Selectmen, the 5-member Earthwork Advisory Committee shall serve for one-year terms expiring May 31st. The Committee will serve in an advisory capacity to the Berlin Board of Selectmen which serves as the Earthwork Board pursuant to Section 1 of Berlin General By-Law Article XII – “Earth Removal and Import”.

To the extent possible, the 5-member Committee shall consist of:

• Building Inspector
• 2 Selectmen-appointed committee members (with one or both being a person in the trade of earthwork)
• A member of the Conservation Commission
• A member of the Board of Health

The so-called "Earthworks Bylaws" are contained within the Berlin General Bylaws.  Specifically, read BOTH the :

• Earth Removal and Import Bylaw (Article XII) and the
• Like Kind Soils Bylaw (Article XIX)

Pursuant to Article XIII, Section 5 of the General Bylaws, a local licensing/permitting authority has the option to deny, revoke or suspend a license or permit for failure to pay any local taxes, fees, assessments, betterments or other municipal charges, provided that the party has not filed an abatement application with the Assessors or doesn't have a pending petition before the Appellate Tax Board.  The bylaw includes the procedures to be followed by the licensing authority and alternatives available to the licensing authority when this situation arises.  Licensing authorities may periodically request current tax payment information from the Treasurer/Collector for their consideration of license/permit applications.
